Welcome to CalBuddy ("we," "our," "us"). By accessing or using our application (the "Service"), you agree to comply with and be bound by these Terms of Use. If you do not agree with these terms, please do not use our Service.
2. User Eligibility
Age Requirement: Our Service is intended for individuals aged 16 and above. By using our Service, you confirm that you are at least 16 years old.
Geographic Restriction: Our Service is exclusively available for use within Israel. Accessing or using the Service from outside Israel is not permitted.
3. Account Registration and Management
Account Creation: To use our Service, you must create an account by completing the onboarding survey within the app and linking your account to either your Google Account or Apple Account.
Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Account Termination: You may terminate your account at any time through the app's settings. Upon termination, your access to the Service will cease immediately.
4. User Responsibilities
Compliance with Laws: You agree to use the Service in compliance with all applicable laws and regulations.
Prohibited Activities: You shall not engage in any activity that:
Violates any applicable law or regulation.
Infringes upon the intellectual property rights of others.
Attempts to gain unauthorized access to our systems or networks.
Engages in data scraping, data mining, or similar data extraction methods.
5. Third-Party Services Integration
OpenAI API:We utilize OpenAI's services to analyze and process certain data within the Service. By using our Service, you agree to comply with OpenAI's Terms of Use.OpenAI may securely retain API inputs and outputs for up to 30 days to identify abuse. For more details on OpenAI's data handling practices, please refer to their Platform Docs. Open Food Facts API:Our Service integrates with the Open Food Facts API to provide nutritional information. By using our Service, you agree to adhere to Open Food Facts' Terms of Use.Proper attribution to Open Food Facts is provided within the Service, as required by their terms.
6. Intellectual Property Rights
Ownership: All content, features, and functionalities of the Service are owned by CalBuddy and are protected by intellectual property laws.
User Content: By submitting content to the Service, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute such content within the Service.
7. Disclaimers and Limitations of Liability
No Warranty: The Service is provided "as is" without warranty of any kind, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.
Limitation of Liability: To the maximum extent permitted by law, CalBuddy shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Service.
8. Privacy and Data Protection
Your privacy is important to us. Please refer to our Privacy Policy for information on how we collect, use, and protect your personal data.
Image Retention Policy: To manage storage and maintain optimal app performance, meal images uploaded to the app are retained for up to two weeks. Images older than 14 days may be automatically deleted from our servers and will no longer be accessible. We recommend users save any important data locally if needed.
9. Modification of Terms
We reserve the right to modify these Terms of Use at any time. Changes will be effective immediately upon posting within the app. It is your responsibility to review these terms periodically for any updates.
10. Governing Law and Dispute Resolution
Governing Law: These Terms of Use are governed by and construed in accordance with the laws of Israel.
Dispute Resolution: Any disputes arising out of or in connection with these terms shall be resolved through binding arbitration in Israel, in accordance with the rules of the Israeli Arbitration Association.
